Agreement to Terms

By accessing or using iBuild Calm's services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, please do not use our services.

Our Services

iBuild Calm provides:

  • Custom website development for small businesses
  • Business automation and system integration
  • Website maintenance and updates
  • Consulting and technical support

Services are provided on a project basis with clear deliverables outlined in individual agreements.

How We Work Together

1. Initial Consultation

We discuss your needs, goals, and project scope. This consultation is free and without obligation.

2. Project Agreement

Once we agree on scope and pricing, we'll provide a clear project agreement outlining deliverables, timeline, and payment terms.

3. Development

We build your solution with regular check-ins and updates. You'll have opportunities to provide feedback throughout the process.

4. Delivery

Upon completion and final payment, you receive full ownership of your website and any custom code created for your project.

Payment Terms

  • 50% deposit required to begin work
  • Remaining balance due upon project completion
  • Accepted payment methods: Bank transfer, check, or credit card
  • All prices are in USD
  • No hidden fees or surprise charges

Refund Policy: Deposits are non-refundable once work has begun. If you're unsatisfied with the final result, we'll work with you to make it right.

Your Responsibilities

To ensure project success, you agree to:

  • Provide necessary content, images, and information in a timely manner
  • Give feedback and approvals within reasonable timeframes
  • Ensure you have rights to all content you provide
  • Make payments according to agreed schedule
  • Communicate openly about your needs and concerns

Ownership & Intellectual Property

Upon final payment:

  • You own all custom code, designs, and content created specifically for your project
  • You receive necessary licenses for any third-party components used
  • We retain the right to showcase your project in our portfolio (unless otherwise agreed)
  • We may reuse general techniques and non-specific code in future projects

Service Limitations

While we strive for excellence, please understand:

  • We cannot guarantee specific business results or revenue
  • Website performance depends on hosting and third-party services
  • We're not responsible for changes in third-party platforms or regulations
  • Post-launch support is available but may incur additional fees

30-Day Bug Fix Warranty

We stand behind our work. For 30 days after project delivery, we'll fix any bugs or issues in the original scope at no additional charge. This doesn't include new features, content updates, or issues caused by third-party services.

Limitation of Liability

Our liability is limited to the amount you paid for the specific service. We're not liable for indirect, incidental, or consequential damages, including lost profits or data.

Termination

Either party may terminate a project agreement with written notice. If you terminate after work has begun, you're responsible for payment of work completed. If we terminate (except for non-payment), we'll refund any unused portion of your payment.

Dispute Resolution

We prefer to resolve issues through direct communication. If we can't reach an agreement, disputes will be resolved through mediation in Connecticut. You agree that any legal proceedings will be conducted in Connecticut courts.

Changes to Terms

We may update these terms from time to time. Changes apply to new projects only - existing project agreements remain unchanged. We'll notify you of significant changes via email or website notice.
